How Long Will My Comp Claim Take?
The answer to this question really depends on how quickly an injured worker gets to Maximum Medical Improvement, or MMI, and how quickly their case moves through the discovery process. This is why it is so important to attend all medical, diagnostic, and therapy appointments. It is also important to notify your attorney when there is a denial or any type of delay in your case. Its your attorney’s job to keep your case moving.
The cases that take the longest are those where the claim is accepted, the Employer is paying workers’ comp temporary benefits, and the injured worker is slow to heal. Some can take years. Many cases should be able to be resolved within about a year. So the simple answer to the question is it varies greatly depending on each case, but one to two years is a good goal.
